Review of OSHA’S Criminal Investigation Team & Case Study of Atlantic Drain Fatality and Prosecution. Presentation to discuss newly formed Region 1 Criminal Investigations Team and mission. To discuss: • The recognition of habitual offender and steps taken to prosecute when violations of the OSH Act results in one or more fatalities. - To include a discussion of the recent conviction and sentencing related to a trench investigation resulting in the deaths of two employees. • OSHA’s pursuit of scofflaws who continually receive citations and penalties and consistently disregard them, accumulating large outstanding debt. • Employers who continually violate OSHA standards, putting employees at risk and then after receiving citations, morph their company into new iterations of that company and still continue to violate in an attempt to hide their compliance history to avoid being cited as a repeat violator.
